New Firm, Strong History
The firm launched in 2024 with six founding partners. The three name partners—David Elsberg, Rollo Baker, and Silpa Maruri—first started working together over 15 years ago, and each is a former Co-Chair of a practice group at Quinn Emanuel. Elsberg, Michael Duke, and Vivek Tata were also partners at litigation boutique Selendy Gay Elsberg (now Selendy Gay).

EBM attorneys have acted as trial counsel in matters arising from multibillion-dollar disputes involving busted M&A deals, corporate governance, complex contracts, energy, investment funds, violation of investment guidelines, computer hardware and software, breach of fiduciary duties, bond indentures, securities, fraudulent transfers, insolvency and major bankruptcy proceedings, and more.
Focus on Training
EBM associates are offered early standup opportunities and formal classroom-style trainings. In the firm’s first six months, each associate went to trial or arbitration at least once. New associates benefit from a “How to Succeed as an Associate” training series, and the firm provides quarterly business development training for all associates.
News & Awards
- EBM represented defendant Sol Goldman Investments, LLC, one of New York’s most important real estate companies, against allegations that it had breached its LLC Agreement. The plaintiffs alleged our client manipulated a valuation process to value the business at an artificially low price when the plaintiffs’ branch of the family sought to cash out their interests in the multi-billion-dollar company. The Appellate Division, First Department, affirmed Elsberg Baker & Maruri’s victory on behalf of its client.
- Our partners have represented Class V Stockholders on behalf of a class of former minority shareholders of Dell Technologies Inc. whose shares were repurchased in a December 2018 transaction for a combination of cash and Class C Dell shares. The case settled on the eve of trial in the Delaware Court of Chancery for $1 billion, a result that the presiding judge, Vice Chancellor Laster, described as a “real and unprecedented result for the class.”
- EBM represented two individuals who departed Wall Street trading giant Jane Street Group, LLC, for a competitor, Millennium Management, LLC, to defend them against Jane Street’s claims of trade secret misappropriation and breach of contract. Following expedited briefing and a hearing, the Court denied Jane Street’s motion in its entirety.

David Elsberg was Co-Chair of Quinn’s Investment Fund Practice, Rollo Baker was Co-Chair of the Corporate Governance Practice, and Silpa Maruri was Co-Chair of the Delaware Litigation Practice. Likewise, three of the founding partners, David Elsberg, Michael Duke and Vivek Tata, were previously partners at Selendy Gay Elsberg where they worked together closely for years on a wide array of cases. The team has a long track record of success.
