Litigation: Weil frequently secures headline-making jury verdicts, differentiating us from many other national firms. Attorneys in our Appeals and Strategic Counseling practice are often called upon to litigate before the U.S. Supreme Court, federal and state appellate courts, trial courts and agencies. Most recently, our litigators have played lead roles in the following victories and achievements:
- Antitrust
- Represented Regeneron Pharmaceuticals in securing a $407 million antitrust jury verdict against Amgen Inc. regarding the market for PCSK9 inhibitors.
- Served as global antitrust counsel to Microsoft in its successful $68.7 billion acquisition of Activision Blizzard, defeating the Federal Trade Commission's (FTC) efforts to block the deal.
- Successfully defended Saks Fifth Avenue against an antitrust class action alleging illegal "no hire" agreements, securing a motion to dismiss with prejudice, which was affirmed on appeal.
- Successfully secured antitrust clearance for The Home Depot in its $18.25 billion acquisition of SRS Distribution, Inc., and independent roofing and building supply distributor. The acquisition was the largest in Home Depot’s history.
- Represented Lactalis in its $2.1 billion acquisition of the U.S. yogurt business of General Mills.
- Successfully defended Visa against a multi-billion antitrust challenge brought by its competitor Discover (and its subsidiary Pulse Network) for allegedly monopolizing the debit card industry.
- Class Action
- Obtained dismissal of BASF Corporation from an MDL involving more than twenty antitrust class actions regarding the crops input industry.
- Secured a favorable settlement for Brookfield Asset Management in one of the largest MDL cases in the country, in which plaintiffs alleged that a group of over 40 landlords have used software developed by RealPage Inc. to artificially inflate rental prices for millions of units.
- Obtained near-complete dismissal of 12 of 14 claims against MLB All-star Shohei Ohtani and the other celebrity defendants in the In Re: FTX Cryptocurrency Exchange Collapse Litigation, pending in the Southern District of Florida, involving the collapse of, and alleged fraud committed by, the cryptocurrency exchange FTX.
- Secured victory for lululemon athletica in a nationwide greenwashing federal class action in Florida federal court, alleging misleading claims about the company’s “Be Planet” marketing campaign which is also the subject of a related Canadian Competition Bureau investigation.
- Representing ExxonMobil as lead national trial counsel in defense of numerous high-stakes public nuisance lawsuits regarding plastic pollution. In a key early decision for Exxon, Weil convinced the Eighth Circuit to grant a mandamus relief in one of the actions, a petition that is granted only once or twice per year, at most, by federal courts of appeals.
- Secured dismissal for PepsiCo of a NY Attorney General public nuisance plastics pollution lawsuit.
- Intellectual Property
- Secured a precedent-setting dismissal for SiriusXM in a multi-hundred million dollar case poised to reshape the enforcement of music royalty rate determinations.
- Secured a favorable settlement for mega-retailer American Eagle Outfitters (AEO) as plaintiff in a significant trademark infringement litigation against Amazon.
- Delivered a staggering victory in the U.S. Court of Appeals for the Ninth Circuit for Rimini Street in a billion-dollar copyright dispute with Oracle, setting the standard for infringing “derivative work” under the Copyright Act.
- Won a $100M+ patent infringement jury verdict, affirmed on appeal, for Altria adverse to RJ Reynolds regarding e-vapor technology.
- Negotiated a seismic music royalty settlement for Pandora Media LLC ahead of a multi-billion dollar trial before the Copyright Royalty Board.
- Privacy
- Won a complete victory in the U.S. Court of Appeals for the Sixth Circuit for Paramount Global in a putative nationwide class action alleging violations of the federal Video Privacy Protection Act.
- Secured a highly favorable settlement for University of Maryland Medical System in a privacy class action that sought statutory civil penalties of close to $1 billion based upon alleged violations of Maryland’s Wire Act.
- Secured a new trial on damages for BNSF Railway in the first case ever to go to trial under the Illinois Biometric Information Privacy Act (BIPA), vacating a $228 million class action damages award.
- Securities Litigation
- Won complete victories before the Delaware Supreme Court on behalf of AMC Entertainment in long-running stockholder litigation.
- Secured victories for Warner Bros. Discovery, both in the Southern District of New York and on appeal at the Second Circuit, in a massive securities fraud class action arising out if its industry-defining $43 billion merger.
- Won a major Delaware Supreme Court victory for TripAdvisor in a closely watched fiduciary duty class action challenging its proposed re-domestication to Nevada - implicating the “DExit” Movement.
- Secured dismissal of a novel shareholder derivative “short swing profit” Section 16(b) complaint against affiliates associated with the Estee Lauder Companies, and affirming that win on appeal.
- Secured a favorable class action settlement for Pilgrim’s Pride, resolving litigation stemming from a criminal antitrust indictment related to an alleged price-fixing conspiracy.
- Sports
- Settled a litigation for Warner Bros. Discovery in a contractual dispute with the NBA.
- Settled an antitrust litigation brought by FUBO, attempting to stop a proposed joint venture between Disney, Fox, and Warner Bros. Discovery.
- Representing the Professional Tennis Players Association in a historic legal action revealing systemic abuse, silence, and exploitation of players to drive profits through monopolistic control by the sports’ governing bodies. In an early victory for the client, a judge in the SDNY prohibited the Association of Tennis Professionals (ATP) from threatening and retaliating against putative class members for their potential involvement as plaintiffs.
- Successfully represented a number of Minor League Baseball teams in connection with high-profile litigation, including a cert petition before the U.S. Supreme Court, adverse to Major League Baseball and several of its clubs.
- Garnered a victory before the Supreme Court of Washington State, on behalf of Washington State University and co-plaintiff Oregon State University, in a high-profile dispute regarding the future of the Pac-12 athletic conference
In 2024, Weil’s Litigation Department was named “Litigation Department of the Year — General Litigation” by the National Law Journal.
Restructuring: For more than 50 years, Weil has played a pivotal role in defining restructuring landscape by offering creative, practical, and thoughtful solutions for its clients. In Weil’s Restructuring practice, you’ll learn directly from top leaders in the field while working on the biggest bankruptcy matters in the world. Our Restructuring clients have included Aéropostale, AMC Entertainment Holdings, Brooks Brothers Group, Cano Health, General Electric, General Motors, J. Crew Group, Lehman Brothers, PG&E Corporation, Scandinavian Airlines, Serta Simmons Bedding, Sears Holding Corporation, Takata Corporation and 24 Hour Fitness. In 2025, Weil secured confirmation of Steward Health Care System's Chapter 11 plan.
